LEGAL & ETHICAL COMMITTEE



PRESENTATION

Further to Point 5 Article 152 of the Amsterdam Treaty each state is allowed to do what it wants in the field of health, including transplant activity.

In several countries the recommendations of the European Council and its committee of experts have not yet been applied.

Therefore this Legal & Ethical Committee should initiate some research regarding:

1. Legal aspects :

1.1 The collection of laws, decrees, ministers circulars, guidelines, etc. of all countries where ETCO members are working.

1.2 The comparison of different legislations, for example, what is allowed concerning non-heart beating donors or recipient health safety in each state. The number of donors depends on particular legislations.


2. Ethical aspects :

Confusion between laws and ethics does exist, probably due to the etymological concept of ethics, which means people thought that at a certain time, it is also close to politically correctness. Is an organ recipient more important than the society or not? We could consider several aspects or reflections about ethics, efficacy and medical deontology.

The comparison of European legislations needs the involvement of each ETCO National Key Member. Because several ETCO members are interested in this Legal and Ethical committee, we hope to build a closer cooperation.
